NEWSLETTER TERMS AND CONDITIONS — METAPHORIC TOOLS

if you have found this page, it means that the terms under which we deliver our Newsletter matter to you — and that speaks well of you.

§ 1. KEY INFORMATION ABOUT THE SERVICE PROVIDER

The Newsletter service is provided by:

§ 2. KEY INFORMATION ABOUT THE NEWSLETTER

1. The Newsletter is sent to the email address you provide.

2. The Newsletter contains:

1) information about new products, instruments and accessories available in the Metaphoric Tools store,

2) news from the world of handmade craftsmanship and instrument-making,

3) information about promotions, discounts, special offers and events,

4) educational content about handmade instruments,

5) other marketing and commercial information about the Service Provider’s products and services.

3. If a digital item (e.g. an e-book, care guide, or recording) is shared via the Newsletter, access will be provided in the manner indicated in the email (e.g. by clicking an active link or downloading an attachment).

4. As email programmes often classify messages sent from mailing platforms as SPAM, we recommend adding contact@metaphorictools.com to your list of trusted senders.

§ 3. SUBSCRIPTION AND ACCESS TO THE NEWSLETTER

1. Access to the Newsletter is free of charge — by signing up and providing your email address (and optionally your first name) in the sign-up form.

2. To sign up for the Newsletter:

1) provide your personal details in the sign-up form,

2) accept these Terms and Conditions,

3) confirm your email address — if a double opt-in mechanism is used.

3. The agreement for the Newsletter service is concluded for an indefinite period at the moment you receive confirmation of your subscription.

4. Access to the Newsletter is granted immediately upon conclusion of the agreement, unless otherwise stated in the service description. If you do not receive access, please contact us.

5. You may unsubscribe from the Newsletter at any time, without giving a reason and free of charge, by:

1) clicking the “Unsubscribe” button in the footer of any Newsletter email, or

2) contacting us directly at: contact@metaphorictools.com

§ 4. TECHNICAL REQUIREMENTS

1. The Service Provider informs that the public nature of the Internet and the use of electronically provided services may involve the risk of data being obtained by unauthorised parties. We recommend using up-to-date antivirus software and strong passwords. The Service Provider will never ask you to share your password.

2. To sign up for the Newsletter, you will need:

1) an up-to-date web browser with Internet access (e.g. Chrome, Firefox, Safari, Edge),

2) an active email account.

3. To use the Newsletter and any shared digital content, you will need:

1) an up-to-date web browser with Internet access,

2) an active email account,

3) software capable of opening files in the format in which digital content is delivered (e.g. *.pdf, *.zip, *.doc, *.mp4).

§ 5. COMPLAINTS

1. If the Newsletter service does not conform to the agreement, you may request that it be brought into conformity or — if you are a Consumer — withdraw from the agreement.

2. Complaints may be submitted by email to: contact@metaphorictools.com or in writing to the Service Provider’s registered address.

3. The Service Provider will handle complaints within 14 days of receipt and will inform the Client of the outcome.

4. The Service Provider may refuse to bring the service into conformity with the agreement if doing so is impossible or would require disproportionate costs. Detailed rules regarding complaints about digital services are governed by applicable consumer protection law.

§ 6. WITHDRAWAL FROM THE AGREEMENT

1. If you are a Consumer, you have the right to withdraw from the agreement within 14 days of its conclusion, without giving a reason, by sending an unambiguous statement to the Service Provider (e.g. by email to: contact@metaphorictools.com).

2. You may also withdraw from the agreement if the digital content or service has not been delivered.

3. Upon withdrawal from the agreement, you undertake to cease using any shared digital content and not to make it available to third parties.

§ 7. COPYRIGHT AND LICENCES

1. All content shared as part of the Newsletter — texts, photographs, graphics, recordings, instrument designs and trademarks — constitutes a work protected under copyright law.

2. The copyright to the above materials is held by the Service Provider or by an entity from which the Service Provider has obtained an appropriate licence.

3. All materials shared as part of the Newsletter may only be used for personal, non-commercial purposes, unless otherwise agreed between the parties. Further distribution, copying, downloading or publishing without the written consent of the Service Provider is prohibited.

4. In the event of any infringement of the above provisions, the Service Provider reserves the right to seek compensation. The infringing party may be subject to civil or criminal liability.

§ 8. PERSONAL DATA

1. The controller of your personal data is WOJCIECH WIECONKOWSKI METAPHORIC TOOLS, ul. Slaska 6, 84-230 Rumia, Poland, contact@metaphorictools.com. Your data is processed for the following purposes:

1) data necessary for the conclusion and performance of the agreement (i.e. the delivery of the Newsletter) is processed for the duration of the agreement and the exercise of rights arising from it (Art. 6(1)(b) and (f) GDPR);

2) data provided for marketing and commercial purposes (including the delivery of the Newsletter) is processed on the basis of your consent and the Service Provider’s legitimate interest in marketing its products and services — for no longer than until consent is withdrawn or an objection is raised (Art. 6(1)(a) and (f) GDPR);

3) data may be processed for the duration of the limitation period for claims, for the purpose of asserting or defending against claims (Art. 6(1)(f) GDPR);

4) data may be archived for internal and statistical purposes until an objection is raised or the business purpose ceases (Art. 6(1)(f) GDPR).

2. Your data may be shared with third parties solely to the extent necessary to fulfil the purposes of processing — in particular with the hosting provider (eHost), the email delivery platform (MailerLite UAB, Lithuania) and — where consent has been given — with Meta.

3. The Service Provider uses MailerLite for Newsletter delivery, provided by MailerLite UAB, Paupio g. 46, LT-11341 Vilnius, Lithuania. For further information on MailerLite’s privacy policy, please visit: https://www.mailerlite.com/legal/privacy-policy

4. Under the GDPR, you have the following rights: access to your data, rectification, erasure, restriction of processing, objection to processing, data portability, and withdrawal of consent (without affecting the lawfulness of prior processing). To exercise any of these rights, please contact us at: contact@metaphorictools.com

5. If you believe your personal data is being processed unlawfully, you have the right to lodge a complaint with your national data protection supervisory authority. In Poland: Prezes Urzedu Ochrony Danych Osobowych (UODO), ul. Stawki 2, 00-193 Warsaw. EU consumers may also contact their local supervisory authority.

§ 9. FINAL PROVISIONS

1. By using the Newsletter, you undertake not to transmit any unlawful content and to act in accordance with applicable law and good practices.

2. Out-of-court consumer dispute resolution is available through:

1) a permanent consumer arbitration court at the regional Trade Inspection authority,

2) mediation conducted by the Trade Inspection,

3) the district (municipal) consumer ombudsman,

4) the European Commission’s ODR platform: http://ec.europa.eu/consumers/odr

3. The Service Provider reserves the right to amend these Terms and Conditions for valid reasons, including in particular changes in applicable law, decisions of UOKiK or UODO, court rulings, or significant changes in business conditions. Clients will be informed of any changes in advance.

4. These Terms and Conditions are effective as of: [FILL IN: publication date].

§ 10. GLOSSARY

1. Client — a party that has concluded an agreement with the Service Provider for access to the Newsletter;

2. Consumer — a natural person who concludes an agreement with the Service Provider for purposes not directly related to their business or professional activity;

3. Newsletter — a service provided electronically, consisting of the periodic delivery of marketing, educational and commercial content to a provided email address;

4. Digital content — data produced and delivered in digital form (e.g. e-book, PDF file, audio or video recording);

5. Digital service — a service enabling the Client to create, process, store or access data in digital form;

§ 2. NAJWAŻNIEJSZE INFORMACJE O NEWSLETTERZE

  1. Newsletter wysyłany jest na wskazany przez Ciebie adres e-mail.
  2. W ramach Newslettera udostępniane są:
    1. informacje o nowych produktach, instrumentach i akcesoriach dostępnych w sklepie Metaphoric Tools,
    2. aktualności ze świata rękodzielnictwa i lutnictwa,
    3. informacje o promocjach, zniżkach, ofertach specjalnych i wydarzeniach,
    4. treści edukacyjne dotyczące instrumentów ręcznie robionych,
    5. inne informacje marketingowe i handlowe dotyczące produktów i usług Usługodawcy.
  3. Jeśli w ramach Newslettera udostępniana jest treść cyfrowa (np. e-book, instrukcja obsługi, nagranie), dostęp do niej uzyskasz w sposób wskazany w e-mailu (np. poprzez kliknięcie aktywnego linku lub pobranie załącznika).
  4. Ze względu na to, że programy pocztowe często klasyfikują wiadomości z programów mailingowych jako SPAM, zalecamy dodanie adresu contact@metaphorictools.com do listy zaufanych nadawców.

§ 3. ZASADY ZAPISU I UZYSKANIA DOSTĘPU DO NEWSLETTERA

  1. Dostęp do Newslettera możesz uzyskać nieodpłatnie — poprzez zapis i podanie swojego adresu e-mail (oraz opcjonalnie imienia) w formularzu zapisu.
  2. W celu zapisania się do Newslettera:
    1. podaj dane osobowe w udostępnionym formularzu zapisu,
    2. zaakceptuj niniejszy Regulamin,
    3. potwierdź swój adres e-mail — w przypadku gdy zastosowany został mechanizm podwójnego potwierdzenia (double opt-in).
  3. Umowa o świadczenie usługi Newslettera zostaje zawarta na czas nieokreślony z chwilą wyświetlenia Ci potwierdzenia zapisu do Newslettera.
  4. Dostęp do Newslettera udzielany jest niezwłocznie po zawarciu Umowy, chyba że z opisu usług wynika inaczej. W przypadku nieuzyskania dostępu prosimy o kontakt.
  5. Możesz zrezygnować z Newslettera w każdej chwili, bez podania przyczyny i bez ponoszenia jakichkolwiek kosztów. W tym celu:
    1. kliknij przycisk „Anuluj subskrypcję” lub „Zrezygnuj z subskrypcji” w stopce każdej wiadomości, lub
    2. skontaktuj się z nami bezpośrednio na adres: contact@metaphorictools.com

§ 4. WYMAGANIA TECHNICZNE

  1. Usługodawca informuje, że publiczny charakter sieci Internet i korzystanie z usług świadczonych drogą elektroniczną wiąże się z ryzykiem pozyskania danych przez osoby nieuprawnione. Zalecamy stosowanie aktualnego oprogramowania antywirusowego oraz silnych haseł. Usługodawca nigdy nie zwróci się do Ciebie z prośbą o podanie hasła.
  2. W celu zapisu do Newslettera niezbędne jest posiadanie:
    1. aktualnej przeglądarki internetowej z dostępem do Internetu (np. Chrome, Firefox, Safari, Edge),
    2. aktywnego konta poczty elektronicznej.
  3. W celu korzystania z Newslettera oraz udostępnianych treści cyfrowych konieczne jest posiadanie:
    1. aktualnej przeglądarki internetowej z dostępem do Internetu,
    2. aktywnego konta poczty elektronicznej,
    3. programu obsługującego pliki w formacie, w jakim dostarczana jest treść cyfrowa (np. *.pdf, *.zip, *.doc, *.mp4).

§ 5. REKLAMACJE

  1. Jeżeli usługa Newslettera jest niezgodna z umową, możesz żądać doprowadzenia jej do zgodności lub — jeśli jesteś Konsumentem — odstąpić od umowy.
  2. Reklamacje można składać e-mailowo na adres: contact@metaphorictools.com lub pisemnie na adres siedziby Usługodawcy.
  3. Usługodawca rozpatruje reklamacje w terminie 14 dni od dnia jej doręczenia i informuje Klienta o wyniku.
  4. Usługodawca może odmówić doprowadzenia do zgodności z umową, jeżeli jest to niemożliwe lub wymagałoby nadmiernych kosztów. Szczegółowe zasady reklamacji usług cyfrowych reguluje ustawa o prawach konsumenta (w szczególności rozdział 5b).

§ 6. ODSTĄPIENIE OD UMOWY

  1. Jeśli jesteś Konsumentem, możesz odstąpić od Umowy w terminie 14 dni od dnia jej zawarcia, bez podania przyczyny, przesyłając Usługodawcy jednoznaczne oświadczenie (np. e-mailem na adres: contact@metaphorictools.com).
  2. Możesz odstąpić od umowy również w przypadku niedostarczenia treści lub usługi cyfrowej.
  3. W przypadku odstąpienia od umowy zobowiązujesz się do zaprzestania korzystania z udostępnionych treści cyfrowych i nieudostępniania ich osobom trzecim.

§ 7. PRAWA AUTORSKIE I LICENCJE

  1. Wszystkie treści udostępniane w ramach Newslettera — teksty, zdjęcia, grafiki, nagrania, projekty instrumentów i znaki towarowe — stanowią utwory chronione prawem autorskim w rozumieniu ustawy z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych.
  2. Prawami autorskimi do powyższych materiałów dysponuje Usługodawca lub podmiot, od którego Usługodawca uzyskał stosowną licencję.
  3. Wszystkie materiały udostępniane w ramach Newslettera można wykorzystywać wyłącznie do użytku własnego, chyba że strony ustaliły inaczej. Zabrania się ich dalszego rozpowszechniania, kopiowania, pobierania i publikowania bez pisemnej zgody Usługodawcy.
  4. W przypadku naruszenia powyższych postanowień Usługodawca zastrzega sobie prawo do dochodzenia odszkodowania. Naruszający może ponieść odpowiedzialność cywilną lub karną.

§ 8. DANE OSOBOWE

  1. Administratorem Twoich danych osobowych jest WOJCIECH WIECONKOWSKI METAPHORIC TOOLS, ul. Śląska 6, 84-230 Rumia, contact@metaphorictools.com. Twoje dane przetwarzane są w następujących celach:
    1. dane niezbędne do zawarcia i realizacji umowy (tj. dostarczania Newslettera) przetwarzane są przez czas realizacji umowy i realizacji uprawnień z niej wynikających (art. 6 ust. 1 lit. b i f RODO);
    2. dane podane w celach marketingowych i handlowych (w tym dostarczanie Newslettera) przetwarzane są na podstawie Twojej zgody oraz prawnie uzasadnionego interesu Usługodawcy w postaci marketingu produktów i usług — nie dłużej niż do czasu cofnięcia zgody lub wniesienia sprzeciwu (art. 6 ust. 1 lit. a i f RODO);
    3. dane mogą być przetwarzane przez okres przedawnienia roszczeń w celu ich dochodzenia lub obrony przed nimi (art. 6 ust. 1 lit. f RODO);
    4. dane mogą być archiwizowane do celów wewnętrznych i statystycznych do czasu wniesienia sprzeciwu lub ustania celu biznesowego (art. 6 ust. 1 lit. f RODO).
  2. Twoje dane mogą być powierzone podmiotom trzecim wyłącznie w zakresie niezbędnym do realizacji celów przetwarzania — w szczególności dostawcy usług hostingowych (eHost), platformie wysyłki e-mail (MailerLite UAB, Litwa) oraz — jeżeli wyrażono zgodę — platformie Meta.
  3. Usługodawca korzysta z platformy MailerLite do wysyłki Newslettera, udostępnianej przez MailerLite UAB, Paupio g. 46, LT-11341 Vilnius, Litwa. Szczegółowe informacje dotyczące polityki prywatności MailerLite dostępne są na stronie: https://www.mailerlite.com/legal/privacy-policy
  4. Na podstawie RODO przysługują Ci następujące prawa: dostęp do danych, sprostowanie danych, usunięcie danych, ograniczenie przetwarzania, sprzeciw wobec przetwarzania, przenoszalność danych, cofnięcie zgody (bez wpływu na zgodność z prawem wcześniejszego przetwarzania). § 9. POSTANOWIENIA KOŃCOWE

  1. Korzystając z Newslettera zobowiązujesz się do nieprzekazywania treści o charakterze bezprawnym oraz do działania zgodnie z prawem i dobrymi obyczajami.
  2. Polubowne rozwiązywanie sporów konsumenckich jest możliwe poprzez:
    1. stały polubowny sąd konsumencki przy wojewódzkim inspektorze Inspekcji Handlowej,
    2. mediacje prowadzone przez Inspekcję Handlową,
    3. pomoc powiatowego (miejskiego) rzecznika praw konsumenta,
    4. platformę ODR Komisji Europejskiej: http://ec.europa.eu/consumers/odr
  3. Usługodawca zastrzega sobie prawo do zmiany Regulaminu z ważnych przyczyn, w tym w szczególności w związku ze zmianą przepisów prawa, decyzji UOKiK lub PUODO, orzeczeń sądowych lub istotną zmianą warunków biznesowych. O zmianach Klienci będą informowani z wyprzedzeniem.

§ 10. SŁOWNIK POJĘĆ

  1. Klient — podmiot, który zawarł Umowę z Usługodawcą na dostęp do Newslettera;
  2. Konsument — osoba fizyczna, która zawiera umowę z Usługodawcą w celach niezwiązanych bezpośrednio z jej działalnością gospodarczą lub zawodową;
  3. Newsletter — usługa świadczona drogą elektroniczną, polegająca na cyklicznym przesyłaniu treści marketingowych, edukacyjnych i handlowych na podany adres e-mail;
  4. Treść cyfrowa — dane wytworzone i dostarczone w postaci cyfrowej (np. e-book, plik PDF, nagranie audio lub wideo);
  5. Usługa cyfrowa — usługa umożliwiająca Klientowi wytwarzanie, przetwarzanie, przechowywanie lub dostęp do danych w postaci cyfrowej;
  6. Usługodawca — WOJCIECH WIECONKOWSKI METAPHORIC TOOLS, ul. Śląska 6, 84-230 Rumia, NIP: 5882256306, REGON: 221709919.
