TERMS AND CONDITIONS — METAPHORIC TOOLS ONLINE STORE
Version: 1.2 | Effective date: 27 October 2026
§ 1. SELLER INFORMATION
The online store available at metaphorictools.com is operated by:
WOJCIECH WIECONKOWSKI METAPHORIC TOOLS
ul. Śląska 6, 84-230 Rumia, Poland
Tax ID (NIP): 5882256306
REGON: 221709919
Email: contact@metaphorictools.com
§ 2. GENERAL PROVISIONS
The store operates on the WooCommerce (WordPress) platform at metaphorictools.com.
By placing an order, the Buyer accepts these Terms and Conditions, which are available free of charge on the Store website in a downloadable and printable format.
Contract languages: Polish and English. In case of discrepancy, the Polish version prevails for customers in Poland; the English version applies to all other customers.
§ 3. PRODUCT OFFERING
Metaphoric Tools offers handcrafted musical instruments and accessories in three forms:
- In Stock — finished instruments and accessories, ready for dispatch,
- Made to Order — standard models from the Store catalogue, crafted after the order is placed; the Buyer chooses only from the options listed in the Store,
- Custom Order — an instrument or case made to the Buyer’s individual specification, agreed through the custom order form and confirmed by email.
The Store offers Chadagans (In Stock or Made to Order), flutes and drums (In Stock, Made to Order or Custom Order) and instrument cases (Made to Order or Custom Order).
Each product is labelled In Stock or Made to Order. Due to the handmade nature of every instrument, minor visual differences from product photographs are inherent and do not constitute defects.
§ 4. CUSTOMER ACCOUNT
Registration is free and voluntary. The Buyer may also check out as a guest.
To delete an account, send a request to contact@metaphorictools.com. Data will be removed in accordance with the Privacy Policy, subject to legal retention requirements.
§ 5. IN STOCK ORDERS
In Stock products are held in inventory. Processing and dispatch times:
- Instruments and accessories: dispatched within up to 3 business days of order confirmation.
A shipping confirmation email with a tracking number is sent once the parcel is dispatched.
§ 6. MADE TO ORDER AND CUSTOM ORDERS
Made to Order and Custom Order products are crafted individually after the order is placed. Estimated lead times:
- Flutes: 3–6 months,
- Chadagans: 3–6 months,
- Drums: 1–3 months,
- Instrument cases: flute cases up to 7 days, drum cases up to 14 days,
- Custom Order cases (individual design): 14–30 days,
- Custom Order instruments: from 3 months up to 12 months, depending on the complexity of the project; the exact lead time is agreed individually and confirmed by email before payment.
Lead times depend on the current production queue. The Seller cannot guarantee delivery by a specific date and will inform the Buyer by email of any expected delay. Orders are fulfilled in the sequence received.
§ 7. CHANGES TO MADE TO ORDER AND CUSTOM ORDERS
The Buyer may make free-of-charge changes to the specification of a Made to Order or Custom Order within 10 days of placing the order.
After 10 days, any change to the order (e.g. wood species, tuning, size, engraving) incurs a fee of 50 EUR / 200 PLN. This fee covers the cost of modifying work already in progress and does not apply when the change is required due to a Seller error.
Please contact us as early as possible — if the instrument is in an advanced production stage, changes may not be feasible.
§ 8. PRICES AND PAYMENTS
Prices in the Store are displayed in PLN and EUR. The displayed price is the final price (VAT-exempt — seller not registered as VAT payer at time of launch; prices will be updated if VAT status changes).
Payments are processed by external payment operators: mBank PayNow and Stripe. The payment methods available for a given order are shown at checkout and may include:
- Credit and debit cards (Visa, Mastercard),
- Apple Pay and Google Pay,
- BLIK (for Polish customers),
- Bank transfers and international card payments.
Card data is not stored by the Seller and is processed exclusively by mBank PayNow or Stripe in accordance with PCI DSS standards.
§ 9. SHIPPING
Metaphoric Tools ships worldwide. All parcels are insured during transit.
We choose the carrier (e.g. InPost, DPD, DHL, UPS, FedEx) based on the destination country and the size and value of the parcel. Estimated delivery time after dispatch: Poland 1–3 business days, European Union 3–7 business days, rest of the world 5–21 business days.
The shipping cost depends on the destination country and the weight and dimensions of the parcel. It is calculated automatically in the cart and at checkout once the delivery country is selected, and is always shown before the order is placed. Details: Shipping page.
The Buyer is responsible for providing a correct delivery address. Customs duties, import taxes and local charges for deliveries outside the European Union are paid by the Buyer.
After dispatch, the Buyer receives a tracking number by email. Tracking information may take up to 48 hours to activate.
§ 10. RETURNS, EXCHANGES AND WITHDRAWAL
10.1. Right of withdrawal — In Stock and Made to Order products
A Buyer who is a consumer, or a sole trader buying for purposes not of a professional nature, may withdraw from the contract within 14 days of receiving the goods, without giving a reason.
To withdraw, send a clear statement to contact@metaphorictools.com before the deadline. You may use the form in Appendix 1, but it is not required. Return the goods within 14 days of your withdrawal notice, packed securely to prevent damage in transit.
The Buyer covers the direct cost of return shipping, unless the return is due to a defect or a Seller error. The Buyer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
The Seller refunds all payments received, including the cost of the cheapest standard delivery offered in the Store, within 14 days of receiving the withdrawal notice, using the same payment method the Buyer used. The Seller may withhold the refund until the goods are received back or the Buyer provides proof of having sent them back, whichever happens first.
10.2. Custom Orders — no right of withdrawal
Under Art. 38(1)(3) of the Polish Consumer Rights Act of 30 May 2014 (Art. 16(c) of Directive 2011/83/EU), the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised. Custom Orders are made to the Buyer’s individual specification and therefore cannot be returned.
The Buyer is informed of this before the Custom Order is confirmed. This exclusion does not affect the Buyer’s rights in case of defects described in § 11.
10.3. Exchanges
Exchanges of In Stock and Made to Order instruments are possible on a case-by-case basis within 30 days of receipt. To begin, email contact@metaphorictools.com. Exchanges are for instruments of equal or lesser value. No store credit is issued if the exchange item has a lower value than the original purchase price. Custom Orders cannot be exchanged. Exchanges are a voluntary service and do not limit the statutory right of withdrawal described in 10.1.
§ 11. DAMAGES, DEFECTS AND COMPLAINTS
The Seller is liable for any lack of conformity of the goods with the contract that becomes apparent within 2 years of delivery — towards consumers and sole traders buying for non-professional purposes under Chapter 5a of the Polish Consumer Rights Act, and towards other Buyers under Art. 556 et seq. of the Polish Civil Code.
If the instrument arrives damaged or you discover a defect:
- please do not attempt to repair it yourself,
- email contact@metaphorictools.com with a description and photos of the instrument and its packaging (box and internal protective materials).
Please report transit damage as soon as possible, ideally within 7 days of receipt, so that the Seller can file a claim under the shipment insurance. This request does not shorten the Buyer’s statutory rights.
In case of non-conformity, a consumer may request repair or replacement of the goods. Because no two handmade instruments are identical, replacement is possible only when a comparable instrument is available; the Seller will usually propose free repair in the workshop first. If repair or replacement is impossible, fails, or would be disproportionately costly, the consumer may request a price reduction or withdraw from the contract. The Seller covers the cost of shipping the instrument to and from the workshop for repair.
The Seller responds to every complaint within 14 days of receiving it. Complaints may be submitted in any form; email is recommended.
The following are not defects: normal wear and tear from regular use, damage caused by improper use, storage or self-repair, minor visual variation inherent to handmade production (wood grain, colour, texture), and damage caused by external factors after delivery (moisture, heat, impact).
§ 12. REVIEWS AND RATINGS
The Store currently does not collect or display product reviews. If reviews are enabled, the rules below apply.
Only a person who has bought the product in the Store can review it. The Store checks this automatically — the review form is available only to Buyers whose order for that product is linked to the email address they provide. Reviews from verified Buyers are marked as “verified owner”.
The Seller does not post, commission or order fake reviews, does not hide negative reviews and does not alter the content of reviews. The Seller may remove a review containing unlawful or offensive content, third-party personal data or content unrelated to the product.
§ 13. INTELLECTUAL PROPERTY
All content in the Store — descriptions, photographs, graphics, logos and instrument designs — is the property of the Seller or licensed to the Seller. Commercial use without written consent of WOJCIECH WIECONKOWSKI METAPHORIC TOOLS is prohibited.
§ 14. PERSONAL DATA
Personal data is processed by the Seller as Data Controller in accordance with GDPR. Details are set out in the Privacy Policy and Cookie Policy available on the Store website.
§ 15. OUT-OF-COURT DISPUTE RESOLUTION
A consumer may use out-of-court complaint and redress procedures, for example the free assistance of a municipal or county consumer ombudsman (miejski lub powiatowy rzecznik konsumentów) or mediation offered by the Provincial Inspectorate of Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej). More information is available at www.uokik.gov.pl. Consumers living in another EU country may contact the European Consumer Centre in their country.
The Seller is not obliged to participate in out-of-court proceedings but will always attempt to resolve disputes directly and amicably.
§ 16. GOVERNING LAW
These Terms are governed by Polish law. For EU consumers, mandatory consumer protection provisions of their country of residence also apply. Nothing in these Terms limits statutory consumer rights.
§ 17. AMENDMENTS
The Seller may amend these Terms for valid reasons (changes in law, UOKiK/UODO decisions, material business changes). Buyers will be notified at least 14 days in advance. Amendments do not affect orders already placed.
